Consultation details
The formal consultation on the draft guidance notes on how to interpret the provisions of the Infant Formula and Follow-on Formula Regulations 2007 closed on 13 February 2008. The consultation responses will be placed on this website, alongside the original consultation, as soon as they are collated.
In considering the responses to the consultation, and to take account of additional information received relating to the interpretation of 'advertising', and also the interpretation of 'scientific publication', the Agency has amended Appendix I and II and intends to insert a new Appendix V. Before finalising the guidance notes, the Agency would be grateful for additional views from stakeholders on the content of the following sections only:
- amended Appendix I – Interpretation of 'advertising'
- amended Appendix II – Guidance on 'representation'
- new Appendix V – Interpretation of 'scientific publication'
Period of consultation
Criterion 1 of the Cabinet Office Code of Practice states that a written consultation must be held for a minimum of 12 weeks for at least once during the development of the policy. This consultation is not being held for a full 12 weeks because it is supplementing a previous consultation on the Agency guidance notes on The Infant and Follow-on Formula Regulations 2007, which lasted for the full 12 week period.
Impact Assessment
Criterion 6 of the Cabinet Office Code of Practice states that a consultation must follow better regulation best practice, including carrying out an impact assessment. A comprehensive Regulatory Impact Assessment was carried out for the draft Infant Formula and Follow-on Formula Regulations 2007, and therefore is not required to accompany these draft appendices.
Further information
This consultation has been prepared in accordance with the HM Government Code of Practice on Consultation, which states that a consultation must follow better regulation best practice, including carrying out an Impact Assessment (Regulatory Impact Assessment in Scotland). The assessment is included in the consultation documents.
We are interested in what you thought of this consultation and would therefore welcome your general feedback on both the consultation package and overall consultation process. If you would like to assist us to improve the quality of future consultations, please feel free to share your thoughts with us by using the consultation feedback questionnaire.
Publication of personal data and confidentiality of responses
In accordance with the FSA principle of openness our Information Centre at Aviation House will hold a copy of the completed consultation. Responses will be open to public access upon request. The FSA will also publish a summary of responses, which may include personal data, such as your full name and contact address details. If you do not want this information to be released, please complete and return the Publication of Personal Data Form. Return of this form does not mean that we will treat your response to the consultation as confidential, just your personal data.
