Consultation on the post implementation review of the Plastic Kitchenware (Conditions on Imports from China) (England) Regulations 2011

This routine follow-up Post Implementation Review (PIR) is part of the Statutory Review requirements for English Regulations. The first PIR was carried out in 2016, five years after the Kitchenware Regulations came into force and subsequent reports must be published at intervals not exceeding five years. This PIR is a follow-up to fulfil that requirement.

Consultation Subject

A follow up review consultation from one published in 2016 on The Plastic Kitchenware (Conditions on Imports from China) (England) Regulations 2011 (“the Kitchenware Regulations”), which placed procedural, documentary and enhanced testing requirements for melamine and polyamide (nylon) kitchenware from the People’s Republic of China and the Hong Kong Special Administrative Region of the People’s Republic of China imported into England. This legislation had been implemented due to the scale of reported non-compliance up to 2011.

Purpose of the consultation

Following on from an earlier review published in 2016, to seek stakeholders’ views on the continue need for special provisions for specific procedures, compliance documentation and testing of imports of melamine and polyamide kitchenware from China and Hong Kong. 

As well as to whether the provisions continue to be fit for purpose the consultation also raises questions as to whether changes seen in the market as a consequence of the UK leaving the European Union and the Covid-19 pandemic have future implications for the current provisions.
